Using Mediation to Settle Personal Injury Cases

About This Course
Mediation is a useful tool to help attorneys settle cases in personal injury actions. However, it is crucial to understand and set expectations with clients as to what they can get out of a mediation. There is no final “decision,” but it is instead guided negotiation that can often yield attorneys the best settlement results.
Attorneys will learn how mediations differ from other types of ADR. They will also learn how to successfully complete a mediation in a personal injury action and how to complete a settlement agreement document.
Attorneys who are interested in using mediation and ADR to settle personal injury actions should attend. It will also help attorneys who have already started this process hone their skills in this area. This course is designed for attorneys at any level interested in exploring new ways to settle disputes, especially attorneys who practice in personal injury.
Learning Objectives:
- Define what a mediation is
- Differentiate from other types of dispute resolution
- Determine when mediation is the right path
- Explore the mediation process
- Review skills and tips for a successful mediation
- Assess why a mediation might fail
