Data Privacy Law Issues in Remote and Hybrid Work Environments
About This Course
Companies of all sizes collect more data than ever, including about their employees, with more sophisticated tools to analyze that data. This CLE provides a foundation that equips attorneys with the knowledge necessary to navigate privacy issues in an era of remote and hybrid work.
We will take a deep dive into workplace privacy, including best practices for satisfying legitimate business interests while minimizing legal risks and adverse impacts on morale. We will examine federal laws relating to workplace surveillance and explore selected state laws to highlight unique developments that may herald national trends. We will also cover common law claims that could be asserted in litigation even without general privacy statutes. We will consider evolving discussions around artificial intelligence, large language models, and human resources technologies.
Finally, because increased data collection expands attack surfaces for malicious hackers, we will briefly review data security and data breach reporting obligations.
This course is appropriate for employment attorneys who are new to privacy law, privacy attorneys who are new to employment law, and general counsels who wish to gain familiarity with the evolving intersection of these key operational areas.
