About The Lecturer
Nguyen D. Luu is an experienced immigration attorney admitted to practice in the State Bar of California, Executive Office for Immigration Review, State Department, Department of Homeland Security, United States District Court Northern District of California, United States District Court of Colorado, and 9th Circuit Court of Appeals.
While the firm is based in San Jose, California, Nguyen enjoys representing clients and families throughout the nation and worldwide. Nguyen’s vast immigration experience has enabled him to assist clients from all backgrounds and regions, including Canada, South America, Asia, Europe as well as the South Pacific. Nguyen earned his B.A. from George Mason University and a Juris Doctor from University of Florida.
Nguyen’s practice encompasses a natural crossover of immigration and family law issues, allowing him to serve his clients effectively while obtaining favorable results for his clients. As part of his demanding immigration practice, Nguyen regularly accompanies his clients to interviews at USCIS field offices throughout the San Francisco Bay Area, Immigration Court in San Francisco, and Criminal Courts in Northern California. Nguyen is able to better represent his clients due to his extensive knowledge regarding the local practice and policy of the Immigration Court. Nguyen is an active member of American Immigration Lawyers Association (AILA) and attends local chapter meetings and USCIS liaison meetings to ensure he is apprised of the latest changes in US Immigration laws, procedures and regulations to effectively represent his clients.
Nguyen diligently represents his immigration clients and succeeds in obtaining favorable results in an array of complex proceedings, such as obtaining permanent residency and naturalization for clients, approvals of I-601 waivers, Appeals, Motion to Reopens, Cancellation of Removal matters, and Post-Conviction Relief. In addition to family-based immigration matters, Nguyen also has experience in advising clients on various employment-based visa options, which includes foreign investors, skilled workers, and other professionals (EB-5, EB-2, E-2, L-1, H1-B, etc.).
As a litigator, Nguyen regularly files actions in Federal District Courts, including Writs of Mandamus demanding USCIS to take action on petitions USCIS has failed to adjudicate, Petitions to Correct Date of Birth on Naturalization Certificates, and actions based on Administrative Procedure Act challenging wrongful USCIS decisions. Part of Nguyen’s core philosophy is working closely with his clients to devise short-term solutions while also developing a long-term strategy to maximize favorable outcomes. Nguyen closely evaluates all client matters to consider whether litigation is the proper route to take.
Nguyen served as President of the Vietnamese American Bar Association of Northern California (VABANC) during 2016 and currently serves on the advisory board of VABANC. Nguyen has a deep commitment to pro bono services and frequently volunteers his time providing pro bono services at VABANC’s monthly legal clinic, in addition to AILA’s legal clinic at Jewish Family Services in Los Gatos. Nguyen regularly participates as an immigration law panelist at various Know Your Rights Legal Clinics and Citizenship workshops hosted by local community organizations that serve underprivileged communities. Nguyen has also been active with the Asian American Bar Association of Silicon Valley and served on the Small Firm and Solo Practitioner Committee. Nguyen is a member of the Santa Clara County Bar Association and was appointed to serve on the Professionalism Committee. During 2014, Nguyen was selected to participate in the Barrister Leadership Program by the Santa Clara County Bar Association.
During June 2010, Nguyen volunteered to help provide bilingual, pro-bono legal education clinics in the Gulf States in response to the urgent legal needs of the Vietnamese American community affected by the BP Oil Disaster. The legal clinics provided access and education concerning BP claims policy affecting thousands of Vietnamese fishermen. For his outstanding and invaluable services to the community during the clinics, Nguyen received special Congressional recognition.
Nguyen is fluent in Vietnamese and conversational in Spanish. Nguyen is also a proud volunteer golf coach at The First Tee- Silicon Valley Chapter, a non-profit organization whose purpose is to develop youth through golf, transforming their lives and giving them a brighter future.
