This course is designed to assist attorneys in their practice of negotiating with opposing counsel on settling cases with an emphasis on personal injury actions.

The program discusses how to best negotiate the value of a client’s case and will provide tools for settling a personal injury action at various phases of the matter. The factors determining a case's value will be highlighted, including insurance companies and their policies, venue, liability, evidence, the clients themselves, treatments, and more. Next, the course will cover the breakdown of settlement funds, focusing on disbursement and various types of liens. And lastly, the course will discuss the importance of thorough closing documents and how to protect and enforce a reached settlement.

  • Evaluate how to best negotiate the value of a case and make a settlement that reflects that value
  • Understand the breakdown of settlement funds and how disbursement and liens play a role in that breakdown
  • Analyze the importance of specific closing documents and effective ways to enforce a settlement
