About This Course
This course examines the various channels through which lawyers can resolve conflicts outside of the courtroom and without initiating a trial. The course introduces the different ways conflicts can be resolved, discussing negotiation, litigation, mediation and arbitration. More detail is provided about the different types of mediation and arbitration, the processes through which mediators are selected, the types of cases for which mediation is a good option, and the central goals of mediation. There will include discussion of a variety of cases and resulting case law that serve as examples for this topic. The instructor will also touch on how discovery, subpoenas, evidence, witnesses, and other processes operate in alternative dispute resolution cases.
